If you are a vendor or contractor selling to government, TILMA has significantly reduced the thresholds at which Government is now obligated to have open and non-discriminatory procurement. This provides additional bid opportunities to vendors looking to supply governments in Alberta and British Columbia.

TILMA applies to provincial government procurement. It requires open and non-discriminatory procurement of the following:

  • Goods of $10,000 or greater
  • Services of $75,000 or greater
  • Construction of $100,000 or greater

TILMA applies to MASH sector procurement. It requires open and non-discriminatory procurement of the following:

  • Goods of $75,000 or greater
  • Services of $75,000 or greater
  • Construction of $200,000 or greater

For Alberta, effective April 1, 2009, TILMA applies to the procurement of provincial crown corporations. It requires open and non-discriminatory procedures in the purchase of:

  • Goods of $25,000 or greater.
  • Services of $100,000 or greater.
  • Construction of $100,000 or greater.

For BC, effective April 1, 2009 until March 31, 2010, crown corporations will have the following thresholds:

  • $250,000 or greater for goods.
  • $250,000 or greater for services.
  • $2,500,000 or greater for construction.

Effective April 1, 2010 BC's procurement thresholds for crown corporations will match Alberta's thresholds.

There are some exceptions to procurement under the agreement, including the following:

  • Procurement of health and social services, and services provided by lawyers and notaries
  • Purchases from philanthropic institutions, prison labour or persons with disabilities
  • Purchases from a public body or non-profit organization
  • Goods purchased for representational or promotional purposes
  • Goods required to respond to an unforeseeable situation of urgency
  • Goods intended for resale to the public
